Terms and Conditions

The following are the Terms and Conditions of an agreement between you and Collectify LLC ("Collectify"). By using, browsing, purchasing on the Collectify.com website ("Collectify.com"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and that you agree to comply with all applicable laws and regulations. If you do not agree to these Terms and Conditions, do not access or otherwise use Collectify.com.

These Terms and Conditions were last updated on October 31, 2007. In the event that Collectify changes these Terms and Conditions, Collectify will post notice prominently on our homepage. In addition, if you have registered on Collectify.com, Collectify will contact you via e-mail to notify you about the changes.

  1. I. Limited License
    • Collectify provides the information on Collectify.com for your personal and noncommercial use only. You may not copy, modify, distribute, display, perform, create derivative works from, transfer or sell any information, software, products or services obtained from Collectify.com.
  2. II. Laws and Regulations
    • You may not access Collectify.com from locations where its use or contents are illegal. If you choose to use or purchase from Collectify.com, you do so on your own initiative and are responsible for complying with applicable local laws. In addition, the laws of the State of New York govern these Terms, and Conditions, without giving effect to any principles of conflicts of laws.
  3. III. Posting on Collectify.com
    • You must register to post material on the Collectify.com. At all times, you are solely responsible for the content of any material you post on Collectify.com.
    • You may not post on Collectify.com any material that is defamatory; fraudulent; false or inaccurate; obscene or otherwise objectionable; threatening or abusive; violates anyone's privacy, publicity, or intellectual property rights; or violates of any law or regulation. You may not use Collectify.com in a commercial manner. You may not post material that solicits funds, touts stocks, or advertises or solicits goods or services. You may not post or transmit any material that contains a virus or other harmful component.
    • Collectify is not responsible for any material posted on or otherwise appearing on Collectify.com, except for material signed by an identified representative of Collectify. Collectify is not responsible for screening material posted on Collectify.com for defamation; fraud; falsity or inaccuracy; obscenity; invasion of privacy; copyright or trademark infringement; or any other reason. Collectify reserves the right to remove or edit any material posted on Collectify.com that Collectify, in its sole discretion, considers defamatory; fraudulent; false or inaccurate; obscene or offensive; threatening; abusive; infringing; illegal; stale; or otherwise unacceptable for any reason.
    • Collectify, in its sole discretion, may terminate the registration of any Collectify.com user who directly or indirectly violates any of the Terms and Conditions listed herein.
  4. IV. Copyright Protection Policy
    • Collectify.com respects the intellectual property rights of others, and requires all persons who post materials on Collectify.com to do the same. In appropriate circumstances, Collectify will remove or edit material posted by, or terminate the registration of, any Collectify.com user who engages in copyright infringement.
    • By posting material of any kind on Collectify.com, you grant to Collectify, or warrant that the owner of the copyright in such material expressly has granted to Collectify, a perpetual, world-wide, non-exclusive, and royalty-free license to use such material, in its original or edited form, in connection with articles, books, television and film, on-line content, advertising and promotion, or in any other manner or any other medium now known or later developed. You also warrant that all "moral rights" in such material have been waived by the owner of any such rights.
    • If you believe that material posted on the Collectify.com may constitute copyright infringement, you should send notice to Collectify LLC, 2015 Drummond Street #401, Montreal, QC, H3G 1W7, Canada, or copyright@collectify.com.
  5. V. Copyright and Trademark Notice
    • All content on Collectify.com, including without limitation trademarks, graphics, images, content, button icons, and service names is the sole property of Collectify or is used by Collectify with the express permission of the intellectual property owner. All content on Collectify.com is protected by U.S. and international copyright laws and treaties. Other than browsing and using the site for it's intended purpose, you may not in any way duplicate, distribute, modify, remove, delete, add to, publish, transmit, or in any way exploit any of the content of Collectify.com, in part or in whole.
    • The trademarks, service marks, and logos used and displayed on Collectify.com are registered and unregistered trademarks of Collectify and others. You should not construe anything on Collectify.com as granting, by implication, or otherwise, any license or right to use any trademark displayed on Collectify.com, without the written permission of the trademark owner. You may not use the name Collectify or the Collectify logo in any way, including in advertising or publicity pertaining to distribution of materials on Collectify.com, without prior written permission.
  6. VI. Limited Warranty
    • No Warranties. To the maximum extent permitted by applicable law, Collectify expressly disclaims any warranty for Collectify.com. Collectify provides Collectify.com and any related documentation "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. Collectify does not warrant that Collectify.com will meet your requirements, operate without interruption or be error-free.
    • No Liability For Damages. In no event shall Collectify or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use Collectify.com, the provision or failure to provide support services, even if Collectify has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
  7. VII. Links and Co-Branded Pages
    • Collectify is not responsible for the content or policies available on any other site linked to Collectify.com. Your linking to off-site pages is done at your own risk. Some of the goods and services which you can purchase through Collectify.com may be offered by third parties through linked or "co-branded" pages for which Collectify is only offering access. Collectify expressly disclaims any responsibility or liability for any damage, loss, or injury arising out of the activities of any third-party, the goods or services offered or the content displayed by any of such third-party.
  8. VIII. Violation of Rules and Regulations
    • You are prohibited from posting or transmitting to Collectify.com any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material, or any other material that could give rise to any civil or criminal liability under the law. Collectify reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions, including the right to block access from a particular Internet address to Collectify.com.
